Network Ten’s Conduct Criticized in Bruce Lehrmann Defamation Case: Extension Granted for Appeal Consideration

Bruce Lehrmann has been granted an extension of time to consider an appeal following a federal court hearing that scrutinized Network Ten’s conduct outside the courtroom after the judgment. Justice Michael Lee characterized Ten’s behavior as “discourteous” and “misleading,” particularly noting their assertion of vindication immediately after the judgment was handed down.

Ten’s lawyer, Justin Quill, speaking on behalf of the network, claimed to journalists on April 15th that Ten had been vindicated by the judgment. However, Justice Lee expressed concern over Quill’s remarks, stating they were made without fully digesting the judgment.

Lee emphasized that Ten’s assertion of vindication was misleading, as his judgment had been critical of Ten and Lisa Wilkinson’s conduct in reporting rape allegations, as well as approving Wilkinson’s Logies speech.

In an affidavit released by the court on Wednesday, Quill apologized for his remarks, clarifying that he did not intend to disrespect the court or suggest non-compliance with the law.

Ten’s legal representative, Dr. Matt Collins KC, argued that Quill’s conduct should not impact the costs matter. Collins highlighted Ten’s remorseful approach, with each lawyer filing affidavits explaining their conduct.

Collins revealed that he had been recruited by Ten to advise staff on legal responsibilities following Lee’s criticism of the network for approving Wilkinson’s Logies speech, which resulted in the delay of the criminal trial.

The court also heard for the first time that Lehrmann, who has not worked since 2021, might be bankrupt and unable to meet a costs order.

Lehrmann had until May 13th to file an appeal but has been granted an extension to May 31st.

Lee reserved his decision on costs to a date yet to be determined.

Former Spotlight producer Taylor Auerbach, a late witness in the trial, has asked for his costs in the order of $60,000 to be paid by Lehrmann and Ten.

Lee indicated that he would consider Auerbach’s submission but would be unlikely to grant the full amount requested.
